Challenge
Estate Without a Valid Will
A Kuala Lumpur family came to us after discovering their late father had not left a valid will. The estate included a house in Cheras, two savings accounts, and a unit trust. Three adult children had differing expectations about distribution and were unsure of the legal process for intestacy in Malaysia.
Solution
Letters of Administration
We explained the intestacy rules under the Distribution Act 1958, which the family had not been aware of. We filed for Letters of Administration with the High Court, liaised with the respective banks and Land Office, and kept all three beneficiaries updated with written summaries at each step. The process took 5 months from instruction to final distribution.

All estate assets were transferred to the three beneficiaries in accordance with the Distribution Act. The family reported that the process was less stressful than expected, and that the clarity of communication helped manage disagreements within the family that might otherwise have escalated.

Challenge
Disputed Estate Among Siblings
A client came to us after a disagreement with two siblings over the estate of their late mother. The dispute centred on whether a property had been verbally gifted to one sibling before the mother's death, and whether the existing will accurately reflected the mother's final intentions.

Negotiated Settlement
We assessed the legal position carefully and advised our client honestly — the verbal gift would be difficult to establish in court. We then facilitated a round of negotiations with the other parties, proposing a structured settlement that acknowledged everyone's position without requiring contested litigation. We prepared a family deed of settlement that all parties signed.

The estate was divided under the terms of the agreed deed of settlement rather than through contested court proceedings. The siblings did not need to appear in court, costs were contained, and the process concluded within 4 months. Comprehensive Will for Complex Estate
